Terms of Service

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your use of the Chattina Educational CMS platform ("Chattina", "the Service"), operated by [Your Legal Entity Name], a company registered in Malta ("we", "us", or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service. If you are under 18, you confirm that your parent or legal guardian has reviewed and consented to these Terms on your behalf.

2. Service Description

Chattina is an educational content management system that enables:

  • Educators to create courses, generate secret enrolment codes, and upload HTML-based educational artefacts (interactive web pages, quizzes, and other learning materials)
  • Students to enrol in courses using secret codes and access educational content rendered directly within the platform

All uploaded HTML artefacts are automatically processed by a server-side content sanitization pipeline. This pipeline scans for and neutralises potential security threats (such as cross-site scripting, data exfiltration attempts, and obfuscated code) before the content is made available to students. Educators receive a security audit report for each upload and may approve specific trusted external domains on a per-artefact basis.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorised use of your account
  • Selecting the correct role (Educator or Student) during registration — this determines your access level and permissions
  • Selecting a unique username during profile setup
  • You may also register or sign in using Google Sign-In or Microsoft Sign-In

We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

4. Acceptable Use

You agree not to:

  • Upload content that is unlawful, harmful, threatening, defamatory, obscene, or otherwise objectionable
  • Upload malicious code, viruses, or scripts designed to harm other users or the platform
  • Share enrolment codes publicly or with unauthorised individuals
  • Attempt to access courses or content to which you have not been granted access
  • Use the Service for any commercial purpose unrelated to educational content delivery
  • Interfere with or disrupt the integrity or performance of the Service
  • Scrape, harvest, or collect data from the platform through automated means
  • Impersonate another user, educator, or institution

5. Course Content Moderation

Educators may publish courses publicly on the Chattina discovery page or keep them private (accessible only via secret enrolment codes). Regardless of a course's visibility setting, all course content must comply with these Terms and our quality standards.

We reserve the right, at our sole discretion, to hide, delist, or remove any published course from the public discovery page if it:

  • Does not meet Chattina's high quality standards for educational content
  • Contains incorrect, misleading, or factually inaccurate information
  • Consists predominantly of AI-generated content that has not been meaningfully reviewed, curated, or enhanced by the educator
  • Violates any provision of these Terms, including the Acceptable Use policy
  • Receives sustained negative feedback from enrolled students

A delisted course remains accessible to already-enrolled students and may still be joined via its secret enrolment code. Educators will be notified when a course is delisted and may appeal the decision by contacting support@chattina.io.

6. User Profiles

Each user has a profile that may be publicly visible. Users are responsible for the content they add to their profile, including their display name, biography, and avatar image.

The following profile content is prohibited:

  • Offensive or inappropriate images
  • Impersonation of another person or entity
  • Misleading information
  • Spam links in bio
  • Providing accurate role-specific information: educators may share their title, department, specializations, office hours, and website; students may share their year of study, field of study, and interests

We reserve the right to remove inappropriate profile content and suspend accounts that violate these Terms. Usernames must be appropriate and non-offensive; we reserve the right to reclaim usernames that violate these Terms or are misleading.

7. Third-Party Authentication

Users may authenticate via Google Sign-In or Microsoft Sign-In. By using these third-party authentication providers, you agree to their respective Terms of Service and Privacy Policies (Google's and Microsoft's).

We are not responsible for the availability or operation of Google's or Microsoft's authentication services. Users are responsible for the security of their linked accounts, including maintaining appropriate security settings on those accounts.

8. Profile Visibility & User Responsibility

Profiles are public by default; users can make them private in their account settings. Users are solely responsible for the information they make publicly visible.

We do not guarantee the removal of cached or indexed public profile data after switching to a private profile. Users should not include sensitive personal information in their public profile.

9. Intellectual Property

9.1 Platform ownership

The Chattina platform, including its design, code, logos, and documentation, is owned by us and protected by copyright and intellectual property laws of Malta and the European Union. All rights not expressly granted are reserved.

9.2 User-generated content

Educators retain full ownership of the educational artefacts and course content they upload to Chattina. By uploading content, you grant us a limited, non-exclusive, royalty-free licence to store, process, and deliver your content to enrolled students through the platform. This licence terminates when you delete the content or your account.

You represent and warrant that you own or have the necessary rights and licences to all content you upload and that such content does not infringe any third party's intellectual property rights.

10. Enrolment Codes

Educators are responsible for the secure distribution of their course enrolment codes. We are not liable for unauthorised access resulting from the improper sharing of codes. Educators may request code regeneration through the platform if a code is compromised.

11. Data Protection

Your personal data is processed in accordance with our Privacy Policy, the GDPR (Regulation (EU) 2016/679), and Malta's Data Protection Act (Cap. 586). By using the Service, you acknowledge that you have read and understood the Privacy Policy.

12. Service Availability and Modifications

We strive to maintain continuous availability of the Service but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice. Where possible, we will provide at least 30 days' notice of significant changes.

13. Limitation of Liability

To the maximum extent permitted by Maltese and EU law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability or fitness for a particular purpose.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total aggregate liability to you shall not exceed the amount you have paid us (if any) in the 12 months preceding the claim.
  • Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Maltese law.

14. Indemnification

You agree to indemnify and hold harmless Chattina, its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any third-party rights.

15. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your account if:

  • You breach these Terms
  • Your account is used for unlawful activities
  • We are required to do so by law
  • We decide to discontinue the Service (with at least 30 days' notice)

Upon termination, your right to use the Service ceases immediately. We will handle your data in accordance with our Privacy Policy and applicable data protection law, including your right to data portability.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Malta, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Malta.

Nothing in these Terms affects your rights as a consumer under mandatory EU consumer protection legislation, including Directive 2011/83/EU on consumer rights. If you are a consumer within the EU, you may also bring proceedings in the courts of the Member State in which you reside.

You may also use the European Commission's Online Dispute Resolution (ODR) platform to resolve disputes online.

17. Learning Analytics and Engagement Data

By accessing an artefact within an enrolled course, you acknowledge that Chattina automatically collects engagement data as described in our Privacy Policy (Section 17). This includes time spent, scroll depth, click interactions, and session count — recorded per student, per artefact.

Purpose: this data is used to (a) display your own course completion progress to you, and (b) provide the course educator with aggregate engagement insight across their course artefacts. It is never shared with other students or with educators outside of the course relationship.

Your rights: you may request deletion of your engagement data at any time by contacting support@chattina.io. Deleting your account also permanently removes all associated engagement records within 30 days.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.

19. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
